01 Service Provider

These Terms of Use govern your access to and use of this website and the WordPress plugins sold through it, provided by:

By purchasing, downloading, installing, or using any of our plugins, you agree to be bound by these Terms. If you do not agree, do not use our products.

02 Products and Licensing

Our plugins are distributed under a commercial license managed through the Freemius platform. Each purchase grants you a non-exclusive, non-transferable license to install and use the plugin on the number of websites specified by the plan you purchased.

Unless explicitly stated otherwise, all purchases include:

• Access to all plugin features included in the purchased tier.
• Software updates for the duration of the active license period.
• Technical support via our official support channels for the duration of the active license period.

Free versions of our plugins, where available, are distributed under theGNU General Public License v2.0 (GPL-2.0)or later, as required by WordPress.org.

03 What You May and May Not Do

You may:

• Install and use the plugin on the number of sites permitted by your license.
• Modify the plugin code for your own use on licensed sites.
• Use the plugin for commercial purposes on your own or your clients' websites.

You may not:

• Redistribute, resell, sublicense, or transfer the plugin or your license key to any third party.
• Use the plugin on more websites than permitted by your license tier.
• Remove, obscure, or alter any copyright notices, license headers, or attribution within the plugin code.
• Use the plugin in any manner that violates applicable laws or regulations.
• Attempt to reverse-engineer any obfuscated portions of the premium codebase with the intent to bypass license enforcement.

04 Payments and Subscriptions

Payments are processed by Freemius and Stripe. By completing a purchase you agree to their respective terms of service. All prices are shown exclusive of VAT. Italian VAT (IVA) will be added where applicable in accordance with EU regulations.

Subscriptions renew automatically at the end of each billing period (monthly or annual, depending on the plan you selected). You will receive an email reminder before renewal. You can cancel auto-renewal at any time from your Freemius account dashboard.

Lifetime licenses, where offered, grant perpetual access to the plugin version available at the time of purchase and to all updates released within 12 months of the purchase date.

05 Refund Policy

We offer a 14-day money-back guarantee on all paid plugin purchases. If you are not satisfied with your purchase for any reason, contact us atinfo@intouchdesign.it within 14 days of the original purchase date and we will issue a full refund.

Refund requests submitted after 14 days of the purchase date will be evaluated on a case-by-case basis and are not guaranteed. Refunds are not available for renewals unless a technical issue that renders the plugin completely unusable cannot be resolved within a reasonable timeframe.

06 Updates and Support

We provide updates and bug fixes for all plugins during the active license period. Updates are delivered automatically through your WordPress admin panel (if the license is active and validated) or can be downloaded manually from your Freemius account.

Technical support is provided via email at info@intouchdesign.it. We aim to respond to all support requests within 2 business days. Support is provided in Italian and English.

We reserve the right to discontinue support for versions of WordPress or PHP that have reached official end-of-life status. We strongly recommend keeping your WordPress installation, PHP version, and plugins up to date.

07 Disclaimer of Warranties

Our plugins are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the plugins will be error-free, uninterrupted, or compatible with every third-party theme or plugin. You are responsible for maintaining backups of your website and database before installing or updating any plugin. We recommend using a staging environment for initial testing.

08 Limitation of Liability

To the maximum extent permitted by applicable law, InTouchDesign shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or website downtime, arising from the use of or inability to use our plugins, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our plugins shall not exceed the amount paid by you for the specific plugin giving rise to the claim in the 12 months preceding the claim.

09 Intellectual Property

All plugin code, design, documentation, and branding are the intellectual property of InTouchDesign unless otherwise noted. The purchase of a license grants you a right to use the software, not ownership of the software itself. The "Dev InTouchDesign" name, logo, and any associated trademarks may not be used without prior written permission.

10 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Italy. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Oristano, Italy, unless mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer within the European Union, you may also use theEU Online Dispute Resolution Platformto resolve disputes out of court.

11 Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our plugins or website after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will notify active customers by email at least 14 days before the changes take effect.
